Tell themotion: We are debating on the motion of “This house supports the human rightsordinance for students.”


REBUTTAL


Status quo: Therewas an article in 조선 daily, which was about the schoolwhere no punishment exist. Teachers only could scold to students who misbehave.Right now in the status quo, government is claiming to have point deductionsystem instead of punishment. This system simply means to deduct such amount ofpoints every time when the student misbehaves. However, as the school’s case onthe newspaper, this replaced system is too irresponsible and has a lot ofparadoxes. A few students got out of control and started to ruin classenvironment, every time, by chatting with others, or not concentrating inclass. Even with teacher’s scold, some students tend to ignore it. As a result,because of tiredness, a few teachers resigned from the school and even somestudents moved schools that they thought the class condition was too bad. Whatwe strongly believe is that students who actually misbehave will misbehavewhatever the punishment is. In this case, because of the human rights forstudents, government is giving them more opportunity to do whatever they want,much freely, which is making schools’ environment worse, that not onlyinfluences badly to other students but also destroys teachers’ authority.


Justification:  1. Human right for students is destroyingwhole schools.

             2. The freedom and basic rights doexist unless you do not harm others.

             3. Human rights ordinance forstudents is violating majority students’ human rights.


Team stance:The constitutional rights in students’ school setting may not be equal to thoseothers’ counterparts.


Team split: Me,as a leader of opposition, I will present two arguments about ‘True way of keepingstudents’ rights’ and ‘Violation of schools’ purpose’. And our proud deputyleader of opposition will present our last argument about ‘Giving too mushfreedoms to teenagers can effect badly on forming ego’.


Argument #1:True way of keeping students’ right. The human rights for students claims totreat students as same as adults, who are in real society. Giving them everyhuman rights; right not to get punish or right to speak out whatever they wantto say etc. Theoretically, it seems right but when we actually apply this lawinto real world, it will bring out huge side effects, which are actuallyhappening in schools right now. The biggest side effect that was been seriouslyissued is that some students are distorting and counterploting the law againstteachers. As I suggested in the status quo, just a few, three or four, studentsin each class destroys the class environment. And they are the ones who usuallyget punished. In this case, the human right for students protects those troublemakers’ rights. Even they misbehave; teachers can only scold them or deductpoints which those students do not even care about. Due to concern of thegovernment, it becomes much easier for those trouble makers to ruin class. Noone can deny this because these facts are the things that are really happeningoutside in the society. How can we protect other majority of students’ rightwho really want to study? Because of some students who counterplot the law, howcan we protect others? Is this law the true way of keeping students’ rights?Absolutely not; human rights for students is just a law which claims to sacrificemajority of students to protect some bad students’ rights.


Argument #2:Violation of schools’ purpose. As I claimed in our first argument, the law is protectingtrouble makers’ rights. And they not only influence other students badly, butalso, they are violating teachers’ authority, by law, which is serious.Spanking is the strongest authority which teachers used to have, to teachstudents. Spank, usually hitting, has the important symbolic meanings. Firstly,it gives a strong message that if you ruin the class environment, you will get physicalpain. Secondly, by the pain, teacher can get rid of the impeditive elements, rightaway, that can protect the class environment from getting ruined. Teachers usedto have this authority to do their roles more efficiently. But now, because ofthe human rights for students’, it’s gone. So, let’s look at the situation inschools. Nowadays, some students are getting out control and ruins whole class’senvironment. Teachers do not have any strong powers to regulate those troublemakers anymore. And, as because teachers have lost their powers, teacherscannot fulfill their roles well. Not fulfilling roles means that they cannotteach. And if teachers’ cannot teach, then it’s violating the schools’ purpose.Ladies and gentlemen, what we strongly believe is that the human rights forstudents, which made students out of control, is the main cause that triggersto destroy schools’ purpose, by taking away teacher’s authority, powers toregulate students.

Tell the motion: We are debating on the motion of “Thishouse supports the human rights ordinance for students.”


Definition: “The human rights ordinance for students”,which motion presented, signifies the new law that claims to give as same basichuman rights for students, as adults, which was legislated in Seoul, Korea.And, simply, these human rights contains the right not to be confiscated, rightto hold a rally, right not to get spank and so on.


Status quo: There is a very popular quote, which famousprofessor said, that “The only professions that are allowed spanking are pornstars, prostitute and teachers.” This one sentence shows not only how teachers,sometimes, act aggressively and emotionally toward students, but also shows howstudents’ basic human rights were violated in school. Let me suggest an extremecase which truly happened in the country side high school. This story was alsowritten as an article in the newspaper. There were 6 students who tried tosneak out of the school while doing after-school activity. Finally they gotcaught by their class teacher. Among those 6 students one of them was a troublemaker who used to get punished. And then, teacher noticed the trouble maker andstarted to hit him. According to witnesses the student got bruises on his faceand his nose bone was broken. In this case, even if the students make mistakes,teachers should discipline them as a human, not as an animal. Even we do nottreat animals like this. Not only this case, a lot more cases were on thenewspaper and online. And these facts are the reasons we need the human rightsfor students.


Justification:  1.School is a place where we prepare real society.

                    2.What is so different between 19 years old student and 20 years old adult?

                    3.Just punishing badly influence both for students and teachers.


Team stance: School is not a prison, which the regulationof human rights cannot be justified.


Team split: Me, as a prime minister, I will present twoarguments about ‘Nature of school’ and ‘Efficiency’. And our proud deputy primeminister will present our last argument about ‘Secondary benefits’.


Argument #1: Nature of schools. The definition of ‘school’,which was defined in the Wikipedia, said that the school is an institutiondesigned for teaching students with specific purposes. Where teaches not onlyacademic education but also non-academic education about morality, personality,community activity and so on. As the dictionary defined, school is a placewhere also learns non-academic education; community activity, how we live withothers, how to make friends. These are what we also learn in school. Therefore,school simply has a meaning of a place where we prepare real society for thefuture. We learn how to live. So, if school is a pre-society, environment forthe students should be same as a real society. And to make a same condition,what we strongly believe and need is basic human rights. Without human rights,we as students just learn how to be tamed by higher people.


Argument #2: Efficiency.What are schools for? What are teachers? What is the true authority of schools?These are all for teaching students more efficiently. Schools hire teachers todo their role of teaching students by using their strong authority. However,what we believe is that the human rights for students are the law which cancatch two birds with one stone that not only improve the efficiency of teachingstudents, but also giving teachers an authority. Right now in the status quo,more and more students are having hostility toward teachers. We can prove this,logically, that nowadays; accusation and even lawsuits against teachers aremore and more increasing. Now in real world, when students get spank orpunished harshly, they keep on saying that they will accuse teachers, like habits.In this kind of relationship between students and teachers, how can studentsstudy well, and how can teachers teach well? The situation is getting worse.The good solution is just to give human rights for students. Expressingdissatisfaction and hostility toward teachers mean that students have somethingcomfortableness and worries. So, let them express those more freely. And forthe teachers, they should not think those student’s deeds as defiance with discipline,but teachers should solve problems in communication, harmoniously withunderstandings. So when relationship between teachers and students get better,students would likely to fallow teachers well that gradually helps students toget a good grades and naturally make teachers’ authority stronger. Moreimportantly, to do all of these, students need the human rights.


Argument #3: Secondarybenefits. The problems of teenagers and adults I Korea is seriously bad. Incase of teenagers, who are students, mostly, they just fallow what theirparents and teachers say. They do not have their own specific dreams and do notknow way of pioneering their own life. Creativeness of Korean students had thelowest percentage among Organization for Economic Cooperation and Development(OECD) countries and sixth lowest percentage among 200countries which had an examination of measuring ingenuity and creativity ofstudents. Also, in case of adults, people are becoming selfish. They do notcare much about how government works, or because of problems right in front oftheir eyes, adults tend be careless even for their long-term future. The basicthing that proves this is a vote rate. The last president’s vote rate for wholepeople during election time was less than 60 percent. It means almost half ofthe people who had the vote right did not vote. Voting has important meanings.Voting is directly related to people’s life and country’s future because it’schoosing the representative of the whole people and country. So, why people areacting like this? Why are they so careless? We strongly believe that it’sbecause of the suppression of their human rights since when they were child.Most of adults had hard time because of wars and invasions. They were busyliving day by day. There were always threats. Their human rights wereabsolutely violated. Also, for teenager, students, they have a lot ofregulations of human rights in schools. And as I suggested, limiting humanrights lead to the serious social problems. Let’s find out the solution. Caseof European schools, especially Poland and Finland, their teenagers alreadyhave a same human rights as adults. They showed the top rank of the creativityexam. Students tend to make decisions by themselves, which is independent.Also, by performing the rights to hold a rally, teenagers become active andhave an interest on schools’ future directions, and also due to students,schools changed for the students. This leads Finland to have almost 90 percentof the vote rate and made a country which exists for the people. We believeKorea also can do this by giving human rights for students.
